In general

Some search fields already contain propositions regarding the type of search for the field in question.

If predefined values exist in a search field, they appear when clicking in the field.

In search fields containing no predefined values, it suffices to type the first two letters of a word and the search engine will display all the possibilities containing the sequence of letters entered in the field, in English (en) and in French (fr).

Several words can be combined in a search field, either with AND ("All") or with OR ("Any").

 

In particular

The "Search" field allows for a "full text" search.

The required search format in the "Decision Date" field should be strictly followed, otherwise the search result might be empty (for example, a search using "." or "/" to separate the numbers instead of the required "-" will result in an error message).

The "Case Number" field can be searched using the complete case reference (ex: 2008/A/1615) or the case number only (ex: 1615), if the complete case reference is not known.

The "Parties" field allows to search for the name of a party having been either appellant or respondent.

The "Representatives" field allows to search for the name of a party's representative (either an appellant or a respondent).

The "Arbitrator" field allows to search for the name of an arbitrator whatever her/his position [President of the panel/sole arbitrator, arbitrator named by the Appellant(s) or arbitrator named by the Respondent(s)].

The "Subsequent Appeal" field allows to search for awards that have been the object of a subsequent appeal with a jurisdictional review authority. Three values can be selected:

Swiss Federal TribunalAppeal to the Swiss Federal Tribunal, in application of Art. 190 para. 2 of the (Swiss) Private International Law Act (PILA)
Vaud Cantonal TribunalAppeal to the Supreme Court of the Canton of Vaud, for cases in which all the parties are Swiss or have their seat in Switzerland, in application of Art. 353 ff. of the (Swiss) Code of civil procedure
OtherAppeal to another jurisdictional review authority

 

 

Refiners

With the search results, "Refiners" will appear on the left hand side of the screen. They are terms which enable the search to be refined by limiting the search results to those containing the refiner.

En général

Certains champs de recherche contiennent déjà des informations sur le type de recherche pour le champ en question.

Lorsque des valeurs prédéfinies existent dans un champ de recherche, elles apparaissent directement si l'on clique dans le champ.

Dans les champs de recherche ne comprenant pas de valeurs prédéfinies, il suffit de taper les deux premières lettres du mot recherché pour que le moteur de recherche affiche toutes les propositions comprenant la suite de lettres entrée dans le champ, en anglais (en) et en français (fr).

Plusieurs mots peuvent être combinés dans un champ de recherche, soit par ET ("All"), soit par OU ("Any").

 

En particulier

Le champ "Search" est un champ de recherche "full text".

Attention à bien respecter le format de recherche requis dans le champ "Decision Date", sous peine de n'obtenir aucun résultat (par exemple, une recherche utilisant des "." ou des "/" pour séparer les chiffres au lieu des "-" requis affichera un message d'erreur).

Le champ "Case Number" peut être recherché en utilisant la référence complète de l'affaire (ex: 2008/A/1615) ou seulement le numéro d'affaire (ex: 1615), si la référence complète n'est pas connue.

Le champ "Parties" permet de rechercher le nom d'une partie, que celle-ci ait été appelante/demanderesse ou intimée/défenderesse

Le champ "Representatives" permet de rechercher le nom du représentant d'une partie (appelante/demanderesse ou intimée/défenderesse)

Le champ "Arbitrator" permet de rechercher le nom d'un arbitre quelle que soit sa position [président de la formation/arbitre unique, arbitre désigné par la/les partie(s) appelante(s) ou demanderesse(s) ou encore arbitre désigné par la/les partie(s) intimée(s) ou défenderesse(s)]

Le champ "Subsequent Appeal" permet de rechercher les sentences qui ont fait l'objet d'un appel ultérieur auprès d'une autorité juridictionnelle de contrôle. Trois valeurs peuvent être sélectionnées:

Swiss Federal TribunalAppel au Tribunal Fédéral Suisse, en vertu de l'art. 190 al. 2 de la Loi fédérale sur le droit international privé (LDIP)
Vaud Cantonal TribunalAppel au Tribunal cantonal vaudois, pour les affaires dont toutes les parties sont suisses ou ont leur siège en Suisse, en vertu des art. 353 ss du Code (suisse) de procédure civile
OtherAppel à une autre autorité de contrôle

 

Refiners

Avec les résultats de la recherche apparaissent sur la gauche de l'écran des "Refiners", à savoir des termes permettant d'affiner la recherche en limitant les résultats à ceux contenant le "refiner".
